General Information About The Service Provider

1.- Service description

FERENTBAGS.COM is a web portal for the retail sale of clothing and accessories through this website.

2.- Acceptance of the General Terms and Conditions of Contract

If you wish to be a User of the services and a purchaser of the items from FERENTBAGS.COM, you must read and accept our General Terms and Conditions of Contract, as well as our Legal Notice and Cookie Policy. Any request for services will automatically imply the acceptance of the current General Terms and Conditions of Contract. These General Conditions are subject to the provisions of Law 7/19988, of April 13, on General Terms and Conditions of Contract, Law 26/1984, of July 19, General for the Defense of Consumers and Users, Royal Decree 1906/1999, of December 17, 1999, which regulates Telephone or Electronic Contracting with general conditions, Organic Law 15/1999, of December 13, on the Protection of Personal Data, Law 7/1996, of January 15, on Retail Trade Organization, and Law 34/2002 of July 11, on Services of the Information Society and Electronic Commerce. FERENTBAGS.COM may modify the General Conditions by notifying Customers sufficiently in advance, in order to improve the services offered through our website. By modifying the General Conditions displayed on the website, this notification duty will be considered fulfilled. FERENTBAGS.COM reserves the right to terminate or modify, at its discretion, all or part of the services offered. This will not entitle users of said services to any compensation. In any case, before contracting the services, the General Conditions can be consulted. If any clause included in these General Conditions is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will affect only that provision or the part thereof that is null or ineffective, the General Conditions subsisting in all other respects, considering such provision, or the part thereof that is affected, as not having been made.

3.- Data to consider for compliance with Law 34/2002 on Information Society Services

The FERENTBAGS.COM site belongs to FERENT BAGS SL (hereinafter FERENT), with NIF B05299672 and registered office at Calle Casanova 191, 08036, Barcelona, Spain. For any questions or clarifications, the user can contact our customer service by writing to hello@ferentbags.com.

4.- Registration Requirement

To use FERENT's services or purchase its items, registration is not necessary. Subscribing to news and information via email is not mandatory to purchase an item or customization service. Registration as a User on the www.ferent.shop portal has no associated cost. Registration is revocable, which means the registered User can unsubscribe at any time by sending an email to hello@ferentbags.com. Once unsubscribed, the user will no longer receive any information or promotions from FERENT. Anonymous registrations or registrations with a false email address are not allowed. At the time of registration, the user declares that they are of legal age (18 years old) and have the necessary legal capacity to contract and use the services offered by FERENT. The user assumes all responsibility for the secret password they choose. FERENT assumes no responsibility in cases where the password is used by other persons authorized by the user, nor will it be responsible for damages resulting from unauthorized use. The customer must immediately report any unauthorized use of their password that they may detect.

5.- Prices

The selling prices of the products offered are indicated on the website in the pricing section of the description of each item visible on the portal. Prices are expressed in euros and can be converted to other currencies using Shopify's automatic exchange rate. FERENT markets its catalog worldwide, but as the European market is the main one, public prices are displayed with the relevant VAT for each country. The prices displayed on the website at any given time will be applied to orders placed at that specific moment. However, FERENT may modify its prices at any time, with prior notice before the service request, through publication on the website and, in any case, for orders placed after the date of the change. The price of the items will be as indicated on our website, except in case of a manifest error. Since errors may occur due to circumstances, if we find an error in the price of any of the items ordered, the customer will be informed as soon as possible, giving them the option to reconfirm their order at the correct price or, if they do not wish to, cancel it without any cost. If we are unable to contact the customer, the order will be considered canceled, and any amounts received will be fully refunded. FERENT will not be obliged in any case to supply any item purchased at an incorrect lower price (even if the order has been confirmed) if the price error is obvious and unmistakable and could have been reasonably recognized by the customer as an incorrect price. For custom orders, as the possible variations that the future buyer may want to order for their item cannot be calculated, these prices can only be communicated once the FERENT team knows the full characteristics of the order in detail, including measurements, materials, and any other circumstances the team needs to determine the price. Once calculated by FERENT, the customer will be informed of the price via email for acceptance. In all cases, FERENT will confirm receipt of the order and the content and payment details by sending an automatic email. Once the order is placed, full payment for the products, applicable taxes, and shipping costs will be processed.

6.- Shipping costs

Shipping costs are not included in the item's price; the shipping cost is calculated based on the total price of the items and the destination. Shipping costs are detailed in the "Shipping and Returns" section of the website. Shipments to countries outside the EU may incur additional fees and taxes, which in any case will be the responsibility of the buyer. FERENT commits to undertaking the necessary procedures and preparing the required documentation for customs management. FERENT will under no circumstances be responsible for expenses and/or charges generated at the destination upon receipt of the order, whether these are taxes, duties, or customs fees. FERENT only charges the shipping costs from origin to the destination address. If the customer does not cover the costs generated at the destination that the customs office of their country (or the Canary Islands) may charge upon delivery, their order will be abandoned, and FERENT will be exempt from all responsibility in this regard, with no obligation to refund the purchase amount or shipping costs.

7.- Payment method

The payment methods accepted for purchasing FERENT items are credit or debit card, PayPal, or Sequra.

8.- Delivery times

Product delivery times are calculated in business days from the order confirmation and payment, as follows: Free shipping to Spain from €120 and to the EU from €300. Orders placed before 13:00 are processed the same day: Peninsula 24h (receive next day); Barcelona city 24h or same day (Mon–Fri, until 18:00); Balearic Islands 72h (Mon–Fri); Canary Islands 3–5 business days; Europe 48–72h (Mon–Fri); International 3–7 business days. Times are estimated and may vary due to holidays, remote areas, or logistical issues; orders placed after 13:00 are processed the next business day. If the date for the new delivery exceeds the initially indicated date by more than 7 days, and only if the delay is attributable to FERENT due to lack of stock or other organizational problems, the buyer will have the right to cancel the delivery of that order with a refund of all amounts paid. This cancellation cannot be made in the case of personalized orders or when the delay arises from delivery problems beyond FERENT's control, such as transport strikes or similar.

9.- Delivery and receipt

Orders will be delivered by a transport or courier company, which will be Correos Express, MRW, DHL, GLS, SEUR or Glovo, depending on the destination and shipping method, to the delivery address indicated by the buyer during the order placement. In case of absence, a package arrival notice will be left so that the user can contact the courier company to arrange a new delivery date. If the buyer does not contact them within fifteen days, the products will be returned to the warehouse. The buyer must check, in the presence of the courier, the condition of the merchandise packaging and its contents at the time of delivery. If the purchased items are not delivered (significant delay in delivery compared to the initially set date), the buyer must notify this by email to hello@ferentbags.com in order to allow an investigation to be opened with the company in charge of the delivery service. This investigation can last a maximum of 21 days. If the product is found during this period, it will be immediately re-sent to the buyer's or designated recipient's address in the order. Otherwise, if the product is not found after this 21-day investigation period, FERENT will proceed to re-send the items purchased by the buyer at its own expense.

10.- Item Returns

FERENT accepts returns of purchased items only in the following cases:

  • The products received are not as expected or you do not like them.

  • The products received do not match the order placed.

  • The delivered products have defects or flaws related to the product itself or caused by an incident during the distribution process.

In these specific cases, returns will be made through the Rever platform or by email to hello@ferentbags.com.

FERENT accepts returns within 14 calendar days of receiving the order when: i) the product is not as expected or you do not like it (right of withdrawal); ii) the product received does not match the order placed; or iii) the product has defects or flaws, whether inherent or caused during transport. The request can be made from the customer's web account or by email to hello@ferentbags.com. Within a maximum of 48 business hours, FERENT will confirm the validity of the request and, if applicable, arrange for pickup at the indicated address (at the customer's request by email). Return costs can be consulted in the “Shipping and Returns” section. Items must retain their original tags and show no use other than what is necessary to ascertain their nature, characteristics, and functioning. FERENT will not generally reject returns for lacking original packaging, showing signs of testing, or not being “brand new”; in these cases, in accordance with regulations, the consumer may be liable for loss of value and FERENT may deduct the depreciation resulting from an individual assessment of each product from the refund. Once the merchandise is received and verified, FERENT will issue the refund using the same payment method within a maximum of 30 days (not including shipping costs). If the indicated procedure and deadlines are not followed, no claim for non-conformity can be made, and the products will be considered compliant and without apparent defect. If a return is not accepted for non-compliance with conditions, FERENT will contact you to offer the reshipment of the items (with costs borne by the customer); if this option is not accepted, FERENT may retain the items and their amount.

11.- Ownership of the contents of www.ferentbags.com

All images, texts, and other content offered by FERENT, including the names and logos of ferentbags.com, are protected by copyright and international laws and treaties relating to intellectual property rights. The user has no right to copy, transmit, or distribute these images without FERENT's express consent. All trademarks, trade names, company names, domain names, logos, photographs, images, or other signs used on the ferentbags.com Site are the exclusive property of FERENT and may not be used in any way.
